TERMS
AND CONDITIONS OF
FACTORY
SPONSORED PROGRAM
*Having signed
this Order
Form it is presumed that you have read and understood the terms &
conditions
1. The purchaser
must agree
to the following:
• To purchase a full
consumable
set per printer supplied.
• From then on to
use only
consumables purchased from WPT (Proof of purchase in the form of
invoices
may be required).
• To carry out the
cleaning
processes described in the User Manuals.
• To follow
instructions
from the Help Desk to help determine any problems or assist in
telephone
assisted fix.
• After 12 months
WPT reserves
the right to request return of equipment with one month’s notice to the
customer due to lack of use if less than two (T8008) or four (T8024)
additional
toner cartridges are purchased in any 12 month period.
• Equipment returned
should
be in good working order.
• Agrees to provide
printer
status page as requested.
2. ON-SITE
SERVICE PROVISION
WPT will provide
labour
and materials to repair the equipment during the Plan or the service
life
of the printer, hereinafter called the agreement. Travel expenses are
included
providing the location of the equipment is within a 50-km radius of a
Customer
Service Provider (CSP),a fee may apply if the printer is located
further
than 50-km from the Service Centre. This fee will have to be arranged
between
the CSP and the customer but would typically be $0.50 to $1.00 per
kilometre
travelled. Requests for Service are to be logged with WPT’s Help Desk
on
1300 138 839.
3. HOURS OF
SERVICE PROVISION
This agreement does
not
cover work outside WPT’s normal working hours, which are 0900 to 1700
AEST
Monday to Friday inclusive, excluding any Public Holidays.WPT neither
guarantees
nor implies the availability of service outside the said working hours.
Any service provided outside the said working hours will be charged at
WPT’s normal premium rates in force at that time and such charges are
not
included in this plan.
4. PAYMENT
The Plan is not
invoked
until payment has been made in full.If during the Plan period any
credit
account is beyond terms during the Plan period, WPT reserves the right
to withdraw the printer until the account returns to within terms.
Title
to the consumables and any options does not transfer until payment has
been received in full.
5. AGREEMENT
The customer agrees
with
WPT as follows:
(a) to provide
access to
the equipment at all reasonable times to WPT’s service personnel and
vehicles
to enable WPT to carry out service under the agreement.
(b) To operate and
care
for the equipment as described in the manufacturer’s published
literature.
(c) The customer
shall make
available to WPT all necessary drawings, handbooks, manuals and other
technical
data relating to the attached equipment and shall upon request and for
the assistance of WPT in undertaking the agreement provide staff
familiar
with the customer’s program and/or applications.
(d) The customer
shall not
perform nor attempt to perform or cause to be performed any repairs to
the equipment during the Terms of this Agreement except as expressly
authorised
by WPT in writing.
6. EQUIPMENT
(a) The equipment
remains
the property of WPT.
(b) Full
responsibility
for the equipment lies with the customer until returned to WPT. Any
equipment
loss shall be replaced at the customer ’s expense and charged at the
published
corporate price.
(c) WPT shall be
liable
for any damage to the equipment caused by negligence of its employees.
(d) WPT shall not be
liable
for any loss of business or profits or for any other consequential loss
or damage suffered by the customer or any third party arising from any
act, default, omission, negligence or delay of WPT or it’s employees or
from any defective or incorrect component or material supplied by WPT
or
from the equipment being out of action or incorrectly adjusted and any
liability therefore is hereby specifically excluded.
7. NOTICE
The customer shall
give
WPT 30 days prior written notice of any return of equipment or any
change
in location of equipment. Immediately on relocation of the equipment
WPT
shall be entitled to inspect the same at the customer’s cost and check
that it is in good operating condition. Any repairs required to put the
equipment in such condition shall be paid for by the customer at WPT’s
prevailing service rates except for such repairs necessary to correct
any
faults which had been notified to WPT in writing prior to the
relocation
of the equipment. It is important when returning or moving equipment to
follow de-installation instructions to the letter or have the move
carried
out by an experienced Engineer. A Return Authorisation Number is
required
from WPT before the return of any equipment and may be obtained by
telephoning
1300 138 839. Equipment returned without a RAN will not be accepted.
The
cost of the return of the equipment is the customer’s. To ensure safe
return
retain original packaging. A cost is involved if replacement packaging
is required.
8. This agreement
is not
transferable.
9. The laws of
Australia
govern this agreement.
10. WPT is not
responsible
for failure to service due to cause beyond its reasonable control.
11. Subject to
the provisions
of the Privacy Act, the customer agrees to receive and review
information
about Tally and other WPT products from time to time.
12. ENTIRE
AGREEMENT
The foregoing terms
and
conditions shall form the entire agreement between WPT and the customer
and shall not be varied by the terms and conditions of any order
submitted
by the customer for the repair and maintenance of the equipment.
13.
CONSUMABLES OR SUPPLIES
This Plan excludes
parts
and components that are termed as “consumable” or “supplies”. The
following
are termed as “consumable” or “supplies”.
• All four toner
cartridges.
• Fuser Unit
• Waste Toner Pack
• OPC Belt
• Drum/image unit
• Transfer unit
The consumption
of these
items is at the expense of the customer.
14. The customer
agrees to
return all toner cartridges, OPC, fuser, drum/image and transfer units
to WPT for environmentally friendly disposal or remanufacture.
15. WARRANTY
CONDITIONS
WPT printers are
warranted
to be free from defects in material and workmanship for a period of
years
or number of pages as outlined in Warranty Period. The Warranty Period
may cease in the event of re-sale or transfer of the printer.
The WPT Warranty
does not
cover:
• Damage caused by
accident,
abuse, misuse or installation or operation not in accordance with the
instructions
contained in the Service/User Manual.
• Damage from
tampering
or attempted repair by a person other an an authorised Customer Service
Provider.
• Damage caused by
any consumable
other than genuine WPT Consumables.
• Any printer that
has its
serial number removed or altered.
• Any costs of
removal or
re-installation of the printer.
• A printer used in
excess
of the recommended average duty cycle for that machine.
• Any loss of
profits or
other pecuniary losses or expenses of whatever nature.
• Any injury or
damage to
persons, premises or property other than the machine.
• The service life
of WPT
Consumables as this will vary with use.
• Failures caused by
neglected
user maintenance in accordance with the instructions contained in the
Service/User
Manual.
• Software and
Driver installation
on site (unless part of a pre-paid delivery).
16. PERIODIC
MAINTENANCE
KIT INSTALLATION - OPTION
Printers require
Maintenance
Kits to be fitted at set page counts to maintain Warranty as outlined
in
User Manual. To obtain Maintenance Kits, a full ‘service configuration
page’ including serial number and counter information,must be forwarded
to the Help Desk at WPT (1300 138 839) with the purchase order for each
Maint.Kit required. Once a Maint. Kit is required the customer has the
option to return the printer and replace it with a new printer after
paying
for a full set of consumables or install a Maint. Kit at a subsidised
and
fixed price set out in the price list (subject to exchange rate
variation).
Maint.Kits can be fitted in the field but must be fitted by a CSP.
Maint.Kits
are provided to the customer at a price as indicated in the WPT price
list.
The fitting of Maint. Kits during the Warranty Period is not covered by
the Warranty. The Maint. Kit and the labour charge incurred will be at
the customer’s expense.
17. IIMAGEE -
for the
T8008 model
The term images
means: One
colour (Cyan,Magenta,Yellow or Black) is one image, a secondary colour
is a second image. Therefore a full colour page would require four
images.
